Viewing "Cornelius Berghuis vs. Henry Mammen" (1903).

"Cornelius Berghuis vs. Henry Mammen" (1903).

In September 1903, Henry Mammen pleaded guilty to assaulting Edward Hanlon before Justice of the Peace Cornelius Berghuis, who fined him $10 and costs. Berghuis was also the editor of a weekly newspaper, the Clara City Herald. The case took on a colorful life of its own when the Maynard Progress, another local weekly, published E. H. Keenan's account of the case from Mammen's viewpoint--and listing Mammen as sole author. The Mammen/Keenan story referred to JP Berghuis as "Judge (?) Bughouse," who was a man of "unscrupulous character" and who is "more of a low dirty swine-herder." Editor Berghuis's weekly was called the "Clara City Fog Horn" and "Clara City Pacifer."

Berghuis sued Mammen for libel in Chippewa County District Court. In the trial on December 1, 1903, Judge Gorham Powers ruled that Mammen's article, which clearly was directed more at Justice Berghuis than Editor Berghuis, was libelous per se. The jury awarded Berghuis $200.
